I agree. If it can be shown that a McD employee uploaded the pictures and posted the personal information on-line, he has a case. The defense will try to show it was possible another customer found the phone and did the deed before any McD employee had access to the phone.

For example, the plaintiff says he called the McD and said his phome was prbbably in a certain spot and the manager says he'll go check it and this is after the pics have been uploaded, McD can show reasonable doubt. If, on the other hand, the call comes in, the McD employee says we have the phone and the pics are uploaded AFTER that, the plaintiff has a case.
