If the Mickey D's told him that they secured the phone, but an employee got snoopy, I think he has a case.
For example, the plaintiff says he called the McD and said his phome was prbbably in a certain spot and the manager says he'll go check it and this is after the pics have been uploaded, McD can show reasonable doubt. If, on the other hand, the call comes in, the McD employee says we have the phone and the pics are uploaded AFTER that, the plaintiff has a case.

The Tina Sherman story has reached "Top 10 Google Trends" for the search term "Tina Sherman Nude". But you won't see this hot item featured on McDonald's dollar deal menu anytime soon. The photos were pulled down back in July, making the current Google scavenger hunt all the more futile.
