Mistake on speeding ticket

Unhappy Mistake on speeding ticket

I got pulled over last night for doing 51 on a 40mph road. Officer didn't speak one word to me, just handed me the ticket.

When I got home. I noticed that he wrote 5/2/02 as the M/D/Y for the date of the incident. It happened late last night so he made a mistake in writing 02 instead of 05. Not only did he write this once but AGAIN somewhere near the bottom of the ticket. So basically, he wrote the wrong year twice on my ticket and no where on the ticket does it say it happened late last night.

How can I take this to my advantage? What can I tell the judge once I go to court? Will they throw out my ticket?

Don't know if that will get it out on a technicality, I don't think so but I am not an attorney. Anything that is wrong can be used to point out lack of attention to detail at trial but I don't think it will help. If that is your only defense it will need work.

I have had 5 speeding tickets in 18 yrs of driving and went to court on every one (even though I was ecedding the limit on 4 of those) just to see if they offer a deal to keep it off my record or in case the cop doesn't show. Maybe they will tell him the court date and he will show up three years ago.

You probably already have a warrant out for your arrest since you haven't paid off your three year-old speeding ticket yet.

seems tickets accumilate over the 3-5 year time frame, driving up your insurance rates. if you are planning to keep the car might fight the ticket with a lawyer. either way its $$$


What can I tell the judge once I go to court?
you will most likely talk to the da's office first before your court appearance then attend court.

How can I take this to my advantage?
get a lawyer who does trafic court in the town this occured.

Will they throw out my ticket?
maybe, could settle for a more obscure offence, they just want your money.

No one cares about a mistake, all they care about is your money.

1. Show up early and talk to the Clerk of Court. Ask them if they regularly give probation (6 months without a violation and this one goes away). If the answer is yes, do that, if not...
2. Talk to the DA before court, ask him if he'll accept full payment + court cost but reduce the violation to a non-moving one.

Hey, you might not get either, but you HAVE TO ASK.

sorta happened to a friend of mine, cept the cop put the wrong day. My friend showed proof that he was out of the state (visiting a college) on that date, and thus he couldnt possibly gotten the ticket. so it got thrown out

Don't know about where you live, but in Vancouver, any mistake on the speeding ticket or any other vehicular ticket voids it, whether it be a name mistake, date, or otherwise.

There were some errors on a ticket I got a LONG time ago in Oregon. When I asked the judge about them, he said "so what?", and then set the price of the ticket.

I still can't believe the whole thing. Two cops pulled me over, and keep me on the side of the road for 45-60 minutes. They then write me a ticket for $60. I go to court, take the time of countless people to process my info, etc. I take 20 minutes of court time while the judge sets the bail amount .. of $30. I was sooooo pissed they were willing to put me through all of that for $30. It felt like the city went through so much effort to screw me for $30. Oh, well.

Tell the judge you smelled alcohol on the cop and this is proof he didn't know what he was doing.
