Default Need help with collecting money from a court settlement

About a month and a half ago i took some place to small claims court, won my case, and I have not received my payment yet..what should I do? Can I now talk to the courts to force the defendent to pay? If say the defendent filed an Appeal I would have gotten the notice already right? So he has to pay then right? Help!

I believe so. Go down to the courthouse and record the judgement. This way, if the defendant has property and tries to refi or sell, you have a lien against the property and have to be paid out of the proceeds. Do it now before they skip or refi. Especially if it's a lot of money.

court can produce a writ of judgement, go to police office and request that an asset be seized stating the asset, or that wages are garnished?
the courts are not in the collection business and won't force him to pay, but they will give you the decision which can be used by law enforcement to collect.
that should be atleast 50% accurate
good luck.

You can make him appear before the court and tell you what his assets are. You can ask the judge to have the deputy seize any cash he has on his person at the time and turn it over to you. But about the only way you will get your money is if he owns real estate. You can file a lien against the property, and some day, when he sells it, you will get your money from the escrow company, plus interest. I don't believe an appeal is possible from small claims court, but I am not an attorney and could be wrong.

thanks for the replies people...the settlement is against a pretty large company and i found out yesterday that they have not filed an appeal so I'm guessing either they A) forgot to send me a payment or b) they a bunch of cackers that are hoping that I'll forget
Anyways thanks for the replies people..I'm gonna call the court house to see what I need to do..do I gotta go physically to the place and ask for my money or whether I can send a deputy there to do it or send my lawyer....thanks again
