You need someone other than a friend to do a patent search...you can lose money FAST by patenting something that's already patented. Also, expect to wait a couple of years and spend upwards of $10,000 for the patent.

For the book, there are publishers that publish books for you if you know they won't be accepted by the mainstream companies. These novelty publishers will publish a book for a fee.

Also, I think you can publish your idea for a pen on this website. That will be proof that YOU had this idea NOW.
