Poor Paris...
Yeah... She got hit with probation for a DUI... but come on... who gets 45 days for driving on a suspended license? OJ killed two people and didn't get 45 days (I know he is innocent, but if he did it...). Point is, I think the punishment is a bit excessive and no reason to deny her the ability to pay to go to another jail. Just because the law allows for up to 90 days doesn't mean anyone really gets that much time. In VA, i think its 5-30 days for your 2nd DUI? I do not think one would get 45 days for driving on a suspended unless they had multiple charges. I think the prosecutor just wanted to be a jerk to a celebrity.
Well, i dont know the terms of her probation, but she was arrested for driving on a suspended. The terms must of been that she cannot drive? I guess she can blame her lawyer for getting her probation instead of just a fine and suspension, but its still remains that she is getting 45 days for driving on a suspended. Here is NJ's law for driving on suspended.
"Unless otherwise provided, an habitual offender convicted of operating a motor vehicle or motorized bicycle, while suspended pursuant to this act, shall pay a fine of $1,000.00 and may be sentenced to a term of imprisonment in a county jail, penitentiary, or workhouse, as the case may be, for a period of 30 days, provided, however, that if the habitual offender is involved in an accident resulting in bodily injury to another, he shall, in addition to the fine, be sentenced to a term of imprisonment for not less than 45 days." Key word "MAY" there is no mandatory jail time.
I couldn't find the DUI statute and im hungry, so ill look when i get back from lunch.
I'm not saying she doesnt deserve to get in trouble, I just think it may be a little excessive (not enough to be an abuse of discretion), but i don't think a normal person would have gotten those sanctions for the same offense.
