Default Problems with work

Alright,well on june 30th 2006 I got involved in a hit and run on my bike.....I ended up slam into the rear quarter panel of a car that ran a red light and my head was the first part to hit the ground...the Impact completely knocked me out and my bottom line of teeth slammed into the top causing over $3k in dental work that needed to be done.


I'm already suing my medical Insurance as they are refuse to fix the damaged teeth.

The problem is with my job, I have paid vacation,sick and personal time ,but any time we have unscheduled time off,we get marked with an occurence for a full day and a half for a half day with a total of 11 allowed per year before your terminated.

Before the accident I had a total of 4 occurence, just this week I had my yearly pre-review and found out they marked me with 5 occurences all the same week of the accident even though I contacted them 48 hours before my next shceduled day and I had a doctor excuse both from my personal physician and the ER doctor.

My supervisor refuses to clear them off and I've used almost all my paid time off looking around at schools to transfer to and I need the extra 2 occurences ,so that I can take a trip to california to look at a cpl schools, my job is prepping for back to school merchandise so they are refusing to give any un-paid days off.


So I'm asking what are my options here,I don't have the money to go after them legally and I'd hate to create hatred between me and my supervisor as I need this job for atleast another year.

I don't know what you can do.

it does seem to me you don't value the job much if you're using unscheduled "sick" days to go look at schools, too.

Your medical insurance also probably is not required to cover you for an auto accident.

is your benefit for 11 unscheduled absences? Wouldn't the sick days from your accident fall into this category? That falls under sick time (which you already have a benefit for) right?

See, you said you already had sick time and vacation, but are only allowed 11 unscheduled days. Your 5 days counts as that almost certainly, regardless of excuse.

I know in my job if I have even ONE unscheduled absence (that isn't due to illness or bereavement) I could definitely be in hot water.

LEGALLY, I don't think you have any options. My suggestion is to try to work it out with your company. If they want to keep you they'll allow you to take a day or so.

Sounds like they don't like you. If you contacted them 48 hours ahead it should be an excused absence. That's how it works at my work. Sounds like you need to save those last two unexcused absences unless you can get those five back. In our shop your next port-of-call would be the HR manager's office if you can't work it out with your supervisor.
