Default should I sue my dealership?

to make a long story short my local honda dealership did a goodwill rebuild on my old s2k for the TSB of popping out of 1st and 2nd gear. Needless to say they f'ed up the rebuild and after 5 rebuilds and about a year and half my car was never fixed. Being out of warranty by then I was nearly out of luck. They told American Honda I was abusing the car and Honda denied my claim. Even after many calls the dealer and honda was convinced it was abuse. I was extremely stressed over the situation especially since I KNEW it was their fault and they profiled me as a "stupid kid racer". (i look young, but am 26) The service manager never once would speak to me with any sort of respect. He Immediately would accuse me of abuse without listening to a word of what i said.

The techs at the dealer never Once took the time to properly troubeshoot my car. They did a piss poor sloppy job every time, and blamed ME saying i was abusing the car. I retorted with it was their poor workmanship. Luckily after arguing with American Honda I was able to get another honda dealer to take one last look. They found the problem in less than 2 hours as missing clip causing the car to come out of 4th gear. I traded in the 04 for an 06 and am happy now free of any possible problems.

The car's vin is now blacklisted as abused by owner and even the dealer i traded it into couldnt get it serviced under warranty.

Do you think I should Sue the dealer for Defamation of character, profiling, stress, loss of use and depreciation? I mean how do i know Honda won't deny me on my new s2000 because of what the other honda dealer said about me?

Talk to a lawyer.
My own guess is that you have no chance unless you can prove that you DIDNT abuse it. A major step towards impossible, I'd say.

Agreed.. what evidence do they have that it was abused? They were clearly negligent, and unable to diagnose a simple problem. That fact goes a long way towards showing they are incompetant, and therefore, it's within reason that their claim of abuse is misguided. But I'm no lawyer, so I would go talk to one.

Suing isn't going to do anything but waste even more of your time and money. As it stands, you got away from that situation pretty much unscathed, so other than making the dealership known to be avoided, a lawsuit isn't going to do much for you.

And let the service manager know that the largest S2000 site on earth has his dealership blackballed, but that's about ll the time I'd waste on it.

you might have a case but i doubt it. none of us are lawyers that have posted thus far. call around to different lawyers if thats the route you would like to pursue. some of them give free consults. it may be worth looking into.

How much do you figure you lost (above and beyond normal depreciation) in the transaction of trading the '04 for the '06? That, IMO, is your measure of damages here.
