Default having some performance shop issues!

Hey guys I know I havent been here in awhile. Work and school overwhelm me. With that being said my s2000 was picked up on feb 28th, 2010. We were going to have the bottom end built, head built, fresh tune and dyno. The car was projected to be done and returned by the first week of april (1 month from drop-off date). The first few weeks they kept in touch and answered all my questions with friendly and helpful responses and I felt pretty good about the interactions we were having. The first week of april came and they said that they were waiting on the block to get back from the machine shop and that it had been at the machine shop for 3 weeks. They would call me as soon as it was dropped back off. A week later (april 16th) I called to see any updates because I hadnt heard from them, they gave me the same answer which was "It's still at fowlers getting the block rebuilt and put back together, we will call ya in a couple of days when we recieve it." With that being said I figured it was just that time of the year where they were slammed with customers trying to get there cars ready for the summer. So i waited for 2 more weeks with no call. At this point i was getting a little frusturated knowing that i was suposed to have my car in my posession three weeks prior. I took the initiative to call over to the machine shop so I could see what was going on and what was taking so long (may 3, 2010) When i spoke with the gentleman that owned the machine shop he replied "well buddy, we have no block for a s2000 here and havent received one." I was in disbelief that This whole time they had told me they were waiting on the machine shop to return the block rebuilt when in reality the machine shop had never recieved it from my tuner.
I immediatly called my performance shop and said "look, why did you lie to me saying the block was at the machine shop for the past 5 weeks when in reality it hasnt left your shop". He replied "I'm sorry buddy, I thought they delivered it but i just notice that they hadnt." He promised that they would deliver it the next morning which they did. When they delivered it i demanded that they called me to confirm delivery and that the machine shop call me to confirm recieving delivery which both did. Two weeks later I called my performance shop to see if the block was done and returned and they said no that they hadnt recieved my performance parts yet from there distributer. I asked them how long it would take and they said they would be there in 2 days with tracking number. So i waited another week to call back to check up on it to see if they recieced them and still they said they didnt. This went on until june 13th. I finally called them and they said that they had the wrong parts ordered and that they would get them over night delivered and have them the next day. That did come true and they took the parts to the machine shop and the machine shop had the block rebuilt in 5 days. the block is back at my performance shop now waiting to get put on a lift and has been sitting there ready to get tuned and dyno'd since the 21st of june. Every week they tell me they will call me or that it will be ready and this has been going on since feb 28, 2010. At this point it is now 5 months into it with no block in the car and it sitting there. The ONLY parts I've recieved are rods, pistons, aem true boost, 2 guage pillar pod, tune and dyno. No professional shop should take 5 months to do this and then lie about things while they have 5k of my money and my car in there posession.

My question is this. Do you think this is enough b.s to take legal action? should I contact my attorney? I've dealt with alot of performance shops all across the united states and never have I been lied to, jerked around, or mislead like this in any business transaction ever! They have had $5,000 of my money since Febuary and my car since February and I have not seen my car or anything since then. Advice time gentlemen

If there is anything that doesnt make sense please feel free to ask, I tried to make this as short as possible but i could go into much greater detail. At the beginning of the post I said we were going to build the bottom end and the head. After all of this time, the parts listed at the end of the post are what they have recieved.
So I told them to not even worry about the head at this point

I don't know much about legal stuff but jjist wondering what shop this is. I'm in thre market for a tune shop in Ohio and don't want to end up in this situation.

Sorry for the bad news bud hopes this gets resolved.

pm me and i will give the performance shops name to you. They currently have my car and the last thing i want is for them to catch wind i am speaking of them on a public forum and have them screw with my car to get back at me for the negative publicity. I will tell you that it is located in columbus.

I would be scared to drive it home when they get done with it. I hope you did the funds on credit card so you can contest it.

Agree w/David, easiest route would be to contest thru credit card company. If you paid via check or cash, it gets tougher. Legal action is an option but can be painful, slow and expensive.

My opinion is to stay on them and wait to get your car back. That and pray they really have the know how to do what you are having done. Not many shops have experience with that motor. A lawsuit is going to do nothing but cost you money.

They are a very well known and respected shop. All of my co-workers and friends have advised me to take legal action. They have my car and $5,000 of my money and i dont even know where the damn car is and now they wont answer my calls.

I'm sorry to hear about this and goodluck. I have to agree w/ ubetit. I would continue to check in on your car. Regardless of what's happened until this point, you want your car back and I'm betting the last thing you want is to lose what you've put in or have to pay additional money to someone else to finish the work.
