Default Beware of S-Pod copies on E-Bay!

Watch out, there is someone copying the S-Pods and selling them on E-Bay. These are a very cheap, poorly constructed product. They fit poorly, and are constructed of inferior materials. I have been working with E-Bay for a month to have them removed, and will most likely take legal action of some kind.

have the manufacturers of the real s Pods use Ebays VERO program to get the auctions shut down. After they prove to ebay that they are the copyright holders of that product the auction usually kgoes down within a day or so.

Which reminds me... one of the covers of my S-POD is comming apart (un-glued?)... Anybody else had this problem? I guess it's a simple fix in that I go get some glue and fix it myself... not really worth returning for a replacement... but when I spend that kinda $$$ on something it's a bit aggitating to see it falling apart.

I'm also kinda curious, what's wrong with the people selling that product on ebay... they're not using the (I assume) trademarked name of S-Pod... there are tons of parts (especially for cars) where it's a similiar design from one brand to the next and I don't see any of those being shut down so good luck with that....

This is that same guy out of Oregon that is making those $100 subboxes. Poor workmanship IMO.

it all depends if it's a trademarked design. if it isn't then the s-pod people don't have leg to stand on.

Not that i'm defending these guys; i'm sure quality of their product sucks, but nowhere in the ebay listing does it say that they are "S-Pods". The S-Pod guys suing these guys is like AEM suing the makers and sellers of the the infamous "Ebay Intake". TBH, I don't think that these guys can get in any trouble as long as they're not marketing them under the name of "S-Pods"

Take this with a grain of salt though as I'm probably wrong.

Unless Mark has a patent on the design..... then its determined to be a theft of "intellectual property". Even if these are not manufactured in the US, there are also international laws that apply (big deal now is over in china is the brand knock-offs....cant shut down production, but can stop sales in the US).

I purchased my sub box from this guy. Not a bad job (granted not the best either). It has worked for me, but that does not mean that these are any good. A box is not difficult to build, but something like these would be REALLY hard.

I'm the manufacturer, if you have a problem...why haven't you contacted me for help before posting here? I've had very few returns for repair, but have always taken great care of my customers.

Have been in contact with them. Have also applied for a trademark...2yrs ago(still in process!), but that wasn't enough for e-bay's lawyers. I'm still in the process of getting this guy shut down for trademark and trade-dress violations. According to my attorney trade-dress law prevents S-Pods from being legally copied due to the fact I was first to market with the specific design shape. I should also be protected by the application for trademark. Unfortunately it takes a lot of money to defend against counterfits weather you have a patent/trademark or not. The fact is anyone can copy anything untill they are shutdown by the courts. Copies can be made/sold overseas, then the "owner" of an idea gets to spend their hard earned money to start the process all over again...if he has DEEP pockets. To the best of my knowledge this is the second stealer of my design, the first was selling in the UK for a while.

have you had your lawyers send a ciese and desist letter? Sometimes that will do the trick with bootleggers. I work in the publishing biz and a lot of times that's enough to scare off some people.

good luck, it sucks to be bootlegged it's been happening to me for the last 15 years.
