YEA, i know thats as far as the 5yr old motor wants it to go down however . i think some vendor has a product to help this problem but i never noticed how high it is up untill now.

Just push the top with your hand for that little bit that it sticks up. Even when my car was brand new I was still able to push down the top with my hand a little bit.

Top might not be going down due to the straps getting old and the bar is flipping back to allow it too. I had that problem with my 00, I had to flip the middle bar back as the top was going down.
