I got screwed and had to threaten to sue. I should have went a head and done it anyways.
Short story...
I bought a hard top from Lemar in December. It was damaged by the shipper. 3 reputable body shops quoted me $800 to fix the damage...all saying that the carbon could not be fixed and re-cleared, it had to be painted.
Lemar told me that the claim had been approved in the amount of $500.
Cut to 6 or 7 months later......I'm fed up with his BS about not receiving the money and I do my own investigation.
UPS confirmed that the claim was approved in the amount of $799.07 and payed Feb 18th 2009 (that is when the check cleared) to Chaser Aerodynamics LLC.
Chaser Aerodynamics LLC was reluctant to give full disclosure but said that they would provide records if they were requested and a lawsuit was filed. However they did answer the big questions....
1. They do not have a "fee" for processing shipping claims.
2. They turn over funds to the original buyer (Lemar) within 30 days.
This means Lemar received almost $800 of my money sometime in early March at the latest and lied to me for another 3 or 4 months. I called BS on the who deal and pretended all of the information (check number, date it written & paid) and told his that due to his mishandling the issue I was ready to take the case to court. That got his attention. However he did not have the money to pay me. He wanted to make installments. I only received $600 of the claim and to this day he still owes me the balance.
1. He was dishonest and tried to skim $300 bucks of the top.
2. He spent the money and at that point could not pay me and most likely did not have any intention to do so.
I can't wait till we meet in person....I'm a super nice guy and keep my business and dealing private (for the most part) but I am not the type of guy you **** with.
