You topped out first gear and backed off, so you were doing what? 40-45MPH? What was the speed limit where you were driving? Did you do a clutch drop and spin the tires? Did you loose control of the vehicle? Did you endanger anyones life?

I get the "SLOW DOWN!" yells from pedestrians a lot, even though I may be going at or under the speed limit, it's the sound of the motor at high RPM and they assume I must be going fast. This gets worse if you have a CAI and/or exhaust.

I really don't see how you were breaking the law unless you exceeded the speed limit, but then they have to clocked proof of that, the only thing they have are bystanders that are making assumptions on your actions.

If it's going to get nasty then you need lawyer, wouldn't hurt to video tape an S2000 pusing first gear to redline with some really good audio from the street and the cockpit, then ask after viewing the street shot, "How fast was I going?" then show the cockpit video so they can see the speedo.

Yeah, it doesn't matter...having a car rev on you, then accelerating quickly, topping out a gear, which is not necessary, is inciting a race. I don't care how you look at it, you were racing, or inciting a race. You can lie, tell the truth, either way, you're pretty screwed.

Most of your statement is true, however, I strongly suggest that he tells the truth. He'll still be screwed but so much less than if he'd lie.

We should know if this has happened to thread starter or he's just speaking hypothetically or it's happened to someone else. He did say "hypothetically" so it needs to be clarified. Well, I'm curious as well.

If he's found guilty of racing, I think he's just going to pay a hefty fine, and that's it, since it doesn't involve any vehicular homocide. Am I not right?

They would have to prove that you were actually racing. Technically by your story you were not. Reving your engine doesn't mean a thing. That is like if you tell someone to jump of a bridge and they jump.

Umm, F1s2000, believe it or not, you can get in some legal trouble in your example. Freedom of speech does not include stuff like, the all-time-classic example, yelling "fire" in a crowded theater or inciting suicide.

Guys lets face it: He topped out first gear. If he didn't spin the tires, there is no evidence of racing. Even if he did spin the tires, its still not exactly racing. He stopped at the speed limit. If the guy in the mustang wants to continue to be an ass and keep going, thats his problem. HE hit hte pole. You had NOTHING to do with him hitting the pole!! People try and race me ALL the time! I rarely do but they still keep on going as fast as they can.

Deny it. It's not your fault here. Oh, did someone die? injured? if its just the driver, its his fault for endangering his own life. You didn't hit anyone or anything.

Get a good lawyer.
