Beware of future transmission failures!
I just wanted to start a new thread with this title so more people might look at it. Here is my original thread with my transmission problem.

Here is my original post:
[QUOTE]To make a long story short, My transmission failed about 1.5 months ago and my Honda Care extended warranty covered almost $2000 of it and I covered the $50 deductible. Three gears and three synchros were replaced and the transmission was fine.
Fast forward only 3 to 4 weeks. Now it is March. My transmission starts VIOLENTLY throwing it's self out of first gear. So VIOLENTLY that it felt like someone had hit me with their car. This continued in the coming weeks getting worse and worse. Then it would throw itself out of 1st gear, but the gear was obviously worn and it wasn't quite as violent anymore. Then reverse became very hard to engage.
I took the car to the dealer on Monday, March 15th, for them to repair it again for the second time within 2 months for the transmission. They called me back on Tuesday and told me that the company that runs Honda Care was sending a third party inspector to take photos of my car to see if the damage was from driver abuse. (Honda Care is still owned by Honda, but it's a separate entity)
My service guy said that since the car has a Spugen Dual Ti exhaust, and the tires are bald on the inside, they may have reason to think I am abusing the car.
Ok, I'll play along.
The stock S2000 has 200hp at the rear tires. The Spugen Dual Ti only adds 3 to 7 horsepower. hardly enough to even make the transmission even blink at it. The exhaust was installed after I got the car out of the shop the first time. It was on for about 3 weeks before the car went in the shop again.
Now for the bald tires. I bought my car in July of 2003 from a man in Phoenix Arizona. He replaced the rear tires with new S02's about 1000 miles before I bought it. I even have the documentation from the dealer where he bought them and the mileage the car was at. I bought the car at a little over 27,000 miles. I have not bought new tires since then. I now have approximately 43,000 miles on the car. That is a total of approximately 16,000 miles on the rear tires that he bought.

Here is their answer to me today:
[QUOTE]Good news and bad news.
Good news:
Honda agreed to repair the transmition. But they only agreed to pay for the parts. The parts alone are over $1000.

And the best part:

Oh! I almost forgot! The most infuriating thing that he told me.
After he said that their reasoning for not paying in full was not for the tires, the lowering, or the exhaust. I then asked him, "Then what is their reasoning?"

I see a lawsuit coming...
That is profiling and flat-out discrimination.
Get an attorney.
It also sounds to me that if there wasn't a visible problem with 1st and reverse 2000 miles ago, that they probably reassembled the transmission improperly when they put the new gears in the first time. I would go back to the dealership and hold them accountable for that potential screw-up.

Dude, that sucks. I don't doubt that YOU didn't abuse the car. My only question is: what about the Arizona guy who put on the first 27k miles? That's plenty of time to really F*^& up a car if abused hard... Part of the sucky part of buying used.

i hate to say it but take them to the court.
that is not right and dont make any sense at all.
only if everyone in this world was honest and has integrity, can you imagine what it would be like?

Awful - try arbitration and get an attorney that specializes in car claims - your local bar association can direct you.
I just cannot stand this, and it is one reason i do not go for extended warranties - I had the same trouble with BMW on my M3, when i had a $1000 Borla catback on it and no other mods, and the cylinder head gasket went. It was my fault for "modifying the car". Moss_Magnusson meant nothing to them - I pointed out that there are many muffler shops, and the idiot told me that if it had a Tuffy muffler I would be OK, but since I had a "racing muffler" that indicated driver abuse. What BS. They just make it up as they go along.
By your adjuster's logic, chrome tire valve caps would indicate a racing affinity.
Sue the Bastids!

See a good lawyer, and make sure you get and keep all the parts from the transmission. Denial of warranty because of the kind of car it is; my a**! The new Acura TL with 260 hp puts more strain on its six speed that the s2k's does, especially with ALL THAT TORQUE we have (kidding).
Besides, it is a basic tennant of contract and sales law that a product must be fit FOR ITS INTENDED PURPOSE. The s2k is a sports car (duh). It must be fit for use as such. Honda does not have the luxury of expecting that it will be driven like a base model Civic ----- because any damn fool knows it won't.
And on top of it all, it sounds like first gear is the one messed up. We don't have enough torque (even with a supercharger) to mess up first gear in a proper sports car transmission.
Hope you have witnesses to your being told full warranty coverage was being denied "because of the kind of car it was." That's not going to sell well to any judge and/or jury.
Good luck,
Richard
