I have filed claims with my credit card company and have found it to be an easy process. Look into it.

Looking in to it would definitely be a good idea... but I'm just curious as to what he would claim with his credit card company. Is it as easy as him saying "I bought a set of used wheels from some guy who told me they were in good condition, but one was cracked" and then his credit card company saying "oh sorry about that... well we'll credit you back that money you just charged to him!" It's not as if he didn't receive the wheels... it's that he didn't get them in the condition that he expected them to be in. So if his card was refunded, how does the seller go about getting the wheels back?? I mean, there seems to be a legitimate dispute over the condition of the wheels when they were shipped, and I can't see the credit card company just refunding him the money that easily.

Of course, I could be wrong.

First if anybody notice... the original seller ADMITTED FAULT by saying "I didnt take a picture of the crack since it wasn't a concern" That right there alone means the seller knew about the crack. The seller needs to come forward and do the right thing and buy this man a new wheel and eat the cost. The seller obviously lied in the original FS thread.. here

Which he described all 3 wheels were perfect except for one and that one only had blemishes around the lug nut area. Man up and admit your fault.

It's likely that the seller was somewhat aware of the problem but did not fully disclose it. This could have been done for the intent of fraud (I don't think it was) or simply didn't realize the crack was such a problem. Personally, I don't think there was any ill-will to decieve the buyer.

I think is reasonable for the seller to refund 1/5 of the amount paid for all five to cover the cracked wheel, and the buyer to ship said wheel back to the seller.

If not, I'd say both parties should return the money and wheels, each absorbing the cost of one-way shipping. Both parties are out the same amount, so nobody is taking on a bigger burden. Buyer and seller could walk away from the deal.

Why should the buyer have to even cough up a penny in this situation if they both just refunded the wheels/money or even if the seller only pays 1/5th of the paid amount? Even at 1/5th the buyer has to cough up probably an extra 200 dollars just to get a new wheel.

I should have just bought them new if I have to pay more for damage that I did not cause and was not aware of.

ya, i don't see how ups can cause that kind of damage to a wheel. from what i gather from the other threads, you are only led to believe there is damage to the lug area of the rim, not any of the lips.

clearly the damage was on the lip and was not disclosed. it looks like some major curb damage to me. even if it was damaged in the box, i don't think it would have curbed the wheel like that, it would have looked like a bend. that damage looks like it has had contact with concrete.
