This is my J's snorkle that looks to be the one they used to make the one you pictured.
Here is a pic of my old one that did not require cutting the hood:
As mentioned earlier, there are 2 types of J's snorkle. One that looks like the spoon that doesnt require hood cutting, and another that does. The one you have pictured is, without a doubt, going to require hood cutting.

I was told by the seller that only ap2 hoods will require cutting. I guess there is a difference between ap1 and ap2 hoods. Yours looks to be really thin at the curved area. Do you have a pic of the actual thickness?

Those two pictures are of the two different types of J's snorkles. The first pic is the type that requires hood cutting (AP1 or AP2) and the second pic is of the type that does not require cutting (spoon type).
The main difference in fitting a snorkle between ap1 & 2 is that the AP2 has a reinforcing bar that runs behind the front bumper. In my car, it had to be removed to fit the snorkle, but I have heard of others that did not have that to be the case.
Regardless, the seller is giving you bad info on the hood/snorkle issue. That snorkle that you have pictured will have to have the underside of the hood cut for it to fit. Period.
Very high quality made with a much bigger inlet to the stock air box. The idea is to allow maximum cold air flowing into the engine and intake tempurature will be reduced. this is made to work with the stock hood. No modification is required.
so if its an exact replica, why would it require cutting??

I think you're missing the point.
There are two type of J's authentic snorkel. One that requires hood cutting and one that does not. Both are authentic J's. The main difference is the area that goes over the radiator and metal bar. The one that does not require hood cutting is very thin. The one that requires hood cutting is a little thicker in that area.
Ebeldesign's snorkel is the one which does not require hood cutting
The one that you linked from ebay is a knockoff of the J's that require hood cutting.
Here's the link to the different type of J's intake:
