insurance question

Default insurance question

Hi guys, so my roof got slashed last month and my insurance company gave me the first check($800) which it wasn't enough for the new top so then I went to Honda dealership and got a quote($2700) from them. Now Allstate agreed to pay the difference($1900) but on the second check they put my name and the name of the dealership on it. Is there any way I can cash both check and get myself a new hardtop or I have to let Honda repairs my top? Thanks

if your name is on it i'd say you can cash it. I'd check with the insurance company first to make sure they aren't expecting to see a receipt for it from honda.

In every state I've ever lived in it's up to you who does the repair or even if you chose to get the repair done. The insurance company is responsible to return you to the same state you where in prior to the accident.

Insurance laws vary from state to state so check with the insurance, but do not cash any checks until you are happy with what you have received. Most insurance companies state that upon cashing the check you are agreeing to the amount of the settlement, and they have no further responsibility. If you feel like they are jerking you around then you could always call a competing insurance agent to find out what the laws are in your state.

You're in a jam. You'll need to contact your bank and see if they'll accept the check even though Honda is on it. If not you'll need to ask your insurance to issue you a new check.

This same thing happen to me 2 years ago. One of my old cars was totaled and I was suppose to get paid. The previous owner had a loan and for some reason the DMV showed them as being owner so legally my insurance company had to include them on the check. My bank wouldn't accept it so I had to get a certified document from the credit union releasing interest in the car so I could get a new made out to me. It was a huge headache.

If your bank says they wont cash it, ask if there's any creative [thinking outside of the box] way of cashing it. Otherwise you'll have to contact the insurance company

If there's a lien on the car, the lien holder has the right to ensure that their collateral is repaired. If not, the rules are different.
