To follow up: I don't know if he was on his cell phone...I never saw him...went straight from the car to the ambulance. The guy who was in front of me said that he overheard the Yukon guy telling the police that he sneezed. It must have been a hell of a sneeze!
But he did have insurance (State Farm) and they are refusing to total it. I am upside down on my lease, but I am going to call State Farm tomorrow and see if they'll pay off my lease contract in exchange for me waiving all medical, pain and suffering, and misc. claims.

Get your insurance company involved and make it clear to YOUR insurance company that you want the car totaled out.
Being upside down will make it VERY difficult for you to out of the car on a trade. It will cost you thousands of dollars because of a "sneeze."
Also talk to a laywer. Your offer to not file suit for pain and suffering will carry much more weight as an offer to DROP a suit for pain and suffering.
