My advice, fwiw, is turn your claim into the other guy's insurance co and see what they do. Many years back I was in a slow speed accident in which a car spun out in front of me, and I swerved to avoid hitting the spinning car. I barely tapped the car next to me as I swerved - broke a turn signal light lens on my car and no damage to the other. I was cited for hitting the other car
I submitted the claim to the insurance company for the driver of the spinning car, and they paid for everything.
I differ with those who say "lawyer up" immediately. Give the insurance company a chance to deal with you fairly, and if they don't, then call an attorney. If liability is clear, it's in their best interest to settle with you directly; otherwise they end up paying your claim PLUS legal costs.
If you do engage an attorney, bear in mind that you'll often owe attorney fees if things don't go your way in court.

Adding to my prior post, you can also submit the claim to your own insurance company and get your car repaired; provided, of course, that you had collision coverage in force at the time of the accident. Your insurance co. will go after the other insurer if the other driver's liability is clear. Once they recover against the other driver's insurer, they'll refund your deductible if they recover for 100% of the damage.

seeing how its nobody's fault... ie no one wants to get into accident.
but if theres someone to blame I think the reason why the cop blame you is because you were tale gating? *think i spell it right* since it was raining he's assuming that you would leave extra room for stopping between the 2 cars.... so since u couldn't stop in time, its partially your fault.....
this is what I'm assuming the cop is thinking,
good thing is no one got seriously injured.

Thank you for all of the comments guys. My "GIRL" just called the insurance this morning, so we'll see what happends. I'm currently at school so there isn't much i can do. Thread
