Default A tree snapped in half and fell on my car

I'll have pics tomorrow...

i was picking up my friend from in front of his frat, and the wind snapped a tree in half and it fell on my hood. there are lots of smal lscratches on the hood/bumper. i talked to the cop and he said its a civil matter because the tree is considered property of the appartement that was next to the frat house.

what do i do? if i wasnt in the car i coulve been seriously injured...

i have a ton of ltitle scratches on my hood, bumper, and fender... how much is a fender?

A tree falling like that is an act of god unless the property owner has been warned that the tree was damaged and could fall down or had some other insight into the condition of the tree that you could prove. That is probably not likely in this case so you will have to use your insurance. The good news is that this type of accident will not have an effect on your insurance rates.

i believe this had happened about 10 years ago in Berkeley, off of university and 4th? what happened was, some poor guy was in the path of the falling tree and got killed. in the end, the family sued the city.

take some pictures of the tree - that may help you out. it'll at least show the condition it was in. yesterday 11/20 was a VERY windy day in the bay area.

Sorry to hear that. My friend drove by your car yesterday and told me about it. You could ask your insurance company about a "hypothetical situation" about a tree falilng on your car, and see what they say (without identifying yourself). Most likely they will cover the damage, as mentioned before, as an act of God.

My 60 foot oak tree fell on our next door neighbor's house. His insurance paid for all but stump removal. I was a nice guy and paid his deductible.

You have my empathy for your S. IMO your recourse, as owner of car should be to submit claim for repair to your auto insurance.

from experience (not my car though, but a shed in my back yard that my rear neighbor's tree utterly crushed when it fell.)
