i would not assume its just the diff... if the CEL is on, there is more than the diff.

The only thing you can do is pull the code and hope it isn't a misfire for all of the cylinders, or any for that matter.
I actually had my S shipped to me in MI from MA and the sheet that I had to fill out and look over had EVERYTHING on it. Where all of the dings were inside and out with pictures and circles. It had the odometer reading and everything else you can think of. Get the odometer reading from when it left your place and when you receive the car again check it and see how many miles the guy put on the car. Its the only way you iwll be able to prove anything. Make sure the driver sees it and a lawyer aswell from the sounds of it.

I know Autozone can pull the codes, but could anyone else do it on site? I don't want the car to be driven or started, so someone would have to come to their location.

You may want to have someone you trust pull the codes. More specifically read the "freeze frame"/"snap shot" info. Try to have a dealer you trust pull the info. I'm pretty sure rpm is recorded. So if the CEL came on while he had it, you may have a better idea as to the conditions it was under and how it was being treated at the time. Good Luck

Get the DTC's
pull and record freeze frame data. If Honda does it they may be able to access information to help bolster your case. I don't know exactly what they can pull from the ECU. I'd imagine they could check some things in order to deny a warranty. At any rate even a generic scan-tool can pull at least the following plus more I can't remember.
RPM
Vehicle Speed
Engine Coolant Temp
Intake Air Temp
Throttle Position
Load
etc, etc, etc.

Thank you guys soo much for the help! I should have a few contacts in Las Vegas, so hopefully I can come up with someone trustworthy to look at the car.

Someone local should have an OBD-II scanner to loan you. It won't give you freeze frame info, but will tell you what CEL code triggered.

Some generic OBDII scan-tools do support freeze frame. There is a list in the Helms of supported generic parameters that came be read by non OEM scan-tools.
The one I am using is generic and can access freeze frame data.

Well, the car is on its way back home right now....should be here Thursday and is being directly delivered to a local shop. I will report back with the results of their diagnosis.
