Default Damn CHP

I got a ticket back in early January right by Dudleys bread for doing 75 in a 55. Got the letter in the mail and the fine is $415! Damn. I'm doing traffic school which is still $315 + traffic school fees. Just wanted to rant.

if it makes you feel any better my friend got a carpool violation in a construction zone and his was like 800 something

Cop said I ran a red light, I said I didn't. Got a ticket for $384. Fought it and got my case dismissed.

did the cop sounded happy like... "I GOT U SUCKA"... cause the cop gave me mine sounded like that.

if im you just fight it man...i didnt even fight my 2 speeding tickets i got ...so for the 1st tickets(suspended license for 30 days,traffic school and fine $780) 2nd ticket(suspended license 6 months and fine $1000 and probation for 1 year...)


yours aint bad...so just fight it man

From my experience, fighting a Max Speed ticket is almost impossible. Because it's a Maximum Speed and there is no reason to go over it (I'm assuming you got a max speed ticket, because you said it was from CHP). All the others are easier to fight, because lots of factors come into play.

If you fight it, you are basically hoping that the cop doesn't show up, or send in their trial by declaration info. But from my experience, CHP has nothing better to do, so they show up, and send in the information. Sheriffs and City Police are usually to busy to send in Trial by Dec info.

BTW: My record is 14 wins and 4 loses in doing trial by dec for myself and friends.. The 4 loses were all Max Speed by CHP...

what's the difference between trial by declaration, and just doing the walk-in court?

I'm supposed to walk in tomorrow for a ticket i got...and the clerk said i can contest the ticket there...but if it's walk in, i'm assuming it'll just be the judge and me....no cop...so how's trial by dec different.........

If you go in and fight in, they'll set another date for you to comeback and inform the cop. If you do Trial by declaration, they give you paperwork to fill out and have turned in by a certain date. You get the verdict in the mail.

The difference is:

Cops get paid overtime to go into court. They don't get paid to fill out more paperwork and send it in. hahah

But seriously, that's why you get off more by doing trial by declaration. I have some friends that are cops up in the Los Angeles area. And they tell me when they get the paperwork for trial by dec, they just put it aside, and 9 out of 10 times they forget about it until it's past the due date.

Trial by declaration allows you to plead your case without actually going into court. After you turn in your trial by dec, they send a form to the officer so he can state what happened. A judge will then read both statements and judge based on what was written.

If the officer does not turn in their information, you automatically win, and your bail is returned to you. If you are found not guilty, then your bail is returned to you. If you are found guilty, then you can do Trial de Novo, which gives you a second chance to fight the ticket. If you do Trial de Novo, you have to go into the court to contest it.

Basically, by doing this, you get 2 chances at fighting the ticket, and a higher chance you get off by the officer not turning in paperwork vs. an officer not showing up in court.

at least u get pulled over for doing something wrong.....


u dont know how many times ive gotten fcked over by 5 0 ..

and how many tickets ive gotten which were full bs and i still fight em and still lose..

but damn trial by declaration sounds good..
