Florida cracked windshield law

Default Florida cracked windshield law

My 2002 s2k windshield cracked today on the interstate. My insurance company is going to replace the windshield, I requested that they use OEM glass as I've had bad experiences with aftermarket windshields on other cars. They told me I had to pay the difference between the 2 glasses. I remembered reading a law in florida that if requested they must use oem glass at no extra charge.

If anyone can find that law somewhere that would be awesome, Thanks!

Head to your local court offices, they can atleast tell you and/or provide you hard copy, or atleast point you who to ask next.

Good question, i am currently studying a section on this in my text book about Motor vehicle insurance laws. In Florida, your insurance company is required by LAW to REPAIR or REPLACE your windshield at NO COST to you. No matter how many times you need this safety repair. For one the windshield is now classified as a safety device, equivalent to seat belts and airbags.

Sounds to me that your insurance company is trying to give you an ACV (Actual Cash Value) and they are not suppose to do that on a saftey device. Dispute that with them and tell them they cannot do that, by LAW they are required to replace it for you at NO COST or expense to you like i said above. Insurance companies at times will try to be slick and do things like that so they dont have to pay out as much and people are not aware of it. Like i said, fight it and tell them that they have to replace it with Factory, End of story.

I had my orig windshield replaced in April and insisted on OEM glass and Allstate said OK, no argument. About a month ago I had another Rock hit and crack my windshield and this time I went with PPG, so far I am much happier with the aftermarket glass.

The OEM glass is apparently much softer and given the angle of the windshield is subject to more damage.

BTW the PPG glass is an exact duplicate of the OEM glass, tint, border shading etc.

insurance companies are NOT required by any laws to use OEM parts. check your specific policy for the insurance company's stand on that.

note: If you continually have windshield claims, your rates may get affected, as you'll be seen as an increased risk.

^^^this is correct. insurance companies will use aftermarket stuff when available, the insurance companies are required by Florida law to replace the windshield due to it being a security device as stated above, they will replace it only if you have full coverage on your car, i got screwed by the when i had my civic. my civic was not fully insured and i had to pay out of pocket
