In January, 1-year-old Joey Cosmillo wandered into the backyard and fell into the family pool. When his mother hauled him out, he wasn't breathing. Rescuers were able to bring him back to life, but he suffered severe brain damage and cannot walk, talk or even swallow.
Now, his family faces another burden: One of the rescuers, Casselberry police Sgt. Andrea Eichhorn, is suing, alleging the family left a puddle of water on the floor that afternoon, causing her to slip and fall.

This is absolutely MFing ridiculous. Someone needs to take this biatch behind the building and kick the living shit out of her. Then throw her into the pool.

This is such bullshit.
First of all.....sob sob sob blah blah blah....I feel for the child but it was the parent's responsibility to have that pool child proof!!! I'm sorry, I don't take kindly to child negligence. Yes, accident's happen, but the "pool" accidents have been way too many for parents not to know better.
Second, I can't stand the way the media makes things sound or does not do their homework before printing an article. If the cop was on the job while she fell it is called a "Workmans Compensation Claim." The parents of the child do not get affected by this....only the workers comp insurance providers for the County. ANd Keith....the cop did not get two months of vacation on workmans' comp. They only pay you 60% of your salary and your medical bills when you get injured on the job. That's what the law allows. It's no vacation. And let's say the cop took it further and there is actually an attorney out there dumb enough to file a PI negligence case, it still does not affect the parents......the homeowners insurance company covers that.
If you ask me, this is the family trying to get attention from the community so that they receive donations from the poor fools who fall for this crap. Who's really looking to get paid here? Think about that one.

I agree with Di in the sense that the family should have child proofed the pool area. There is really no reason in this day and age why a pool area would not be child proof.
The burden of proof still lies on the plaintiff proving that negligence resulted in her accident, and that is not as easy as it sounds. She has no history documenting negligence. I don't think a one time occurance is enough. I'd be surprised if it went through.
Personally, I think she should suck it up. She chose a job which posed dangers. Maybe she was negligent in not watching where she was walking. Either way, it's her JOB, in which she's being compensated for.

Also, we have to remember that this is a country that rewards stupidity.
Un####ing believable! I dont care whether or not the pool is or isnt child proof! or what the reason is for the police or Rescue to come to my house or anyones house but you have to be some sort of character to sue a family that has gone thru that. In my words "MAN UP BRO!"
