Wes,
I had a very similar situation as you described. Except it was at my place of work. I should of sued the shit out of the guy, but just let it go and chalk it up to experience (even though I actually got fired about 2 weeks later for some bull shit excuse, which was actually the best thing that happened to me).
I hate cops like that, abusing their power. I understand that they are there to protect the property, but there is no reason to harrass people.
Talk to your lawyer and see what he says. You might not really have a chance since you were outnumbered and it will be their word agains yours. Let us know the outcome.

its very difficult, especially under intimidation like that, but I guess its difficult to realize, if he's off duty, then 1) he cannot arrest you, 2) he can only hold you until the cops get there. He personally cannot arrest you. I would actually like to venture back and just see if I can get arrested and then bring suit to them.
DPS is very strict and they don't usually get along with other cops. I learned this from going out with a neighbor of mine in his DPS Mustang years ago. He doesnt care who you are, doesn't care what force you work for, he'll give you a ticket regardless.
Other options, even if it was just the manager of the restaurant and the security was hired by property management, the manager should have come out with you if it were possible.
I've had horror stories with police in Houston, so not necessarily DPS. Not sure what this guy's problem is, but if you still have the name, I would at least look into it to see if he can get dinged on his record or be fired for abusive power in his off-duty security guard position.
Sorry to hear about that Wes. I'll be waiting for the update on Monday.

Wes,
That sure sounded like one testosterone filled cop.
I went through a "field arrest" process during my freshman year at UT. I was changing my oil(at my apartment complex) and had just got in the car after closing the hood, when a cop car pulled in behind me. On the loudspeaker he told me to get out of the car with my hands up. I get out and then he gets out with his gun drawn at me. He puts handcuffs on me and says that he saw me climbing out of a window next to where my car was parked. The only thing next to the window was some leftover carpet materials that were rolled up and stacked on each other. He took pictures of me and said that if anything turned up missing, he would come back for me. The apartment manager came by to verify that I lived there and made me feel alot better because I was scared sh!tless.
After that incident, I talked to my friends dad who is a lawyer about that experience. He said that there I could only file a complaint to the city of Austin and nothing more. I know what you are feeling, trust me.
