damaged headlights from ebay

gosh, i just spent 30mins writing a nice post but when i previewed it, there was an error and i lost all that i've typed!
Anyways, i shall do this again as you guys should be warned of similar people lurking around ebay..hopefully not many!

The seller's name is afran7861 he is now unregistered user.
No mention of any defects on the headlights at all.
I was probably one of the first to see his advert on ebay as i was desperately looking for a pair to fix my car. When i saw the advert, i emailed him immediately and offered him

Look at his feedback ....... there are 4 ebay users on there that he has bought things from. Each of them should have his address. Send them a nice email and point them to this thread ..... you might get lucky.
I know that I have replied to all emails that I have had regarding buying from sellers on ebay.

just got a call from the seller.
It was a heated conversation as he was angry that i sent in the complain to ebay and got him unregistered. He says he has 5more ebay accounts anyways.
He says the picture on the auction shows that the headlights were indeed damaged and that its sold as seen. can you guys spot the damage? you see, the damage was on both headlights and were at the back of the headlamps where the mounts were, how am i supposed to see the damages from the photo?
I feel that he has misrepresented the item on ebay. As a responsible seller he should have explained that the headlamps has some damages so potential buyers know. Then he says i didn't say the headlamps are in a good condition did i? I went, ofcourse i don't expect them to be excellent condition, i am prepared to accept the scratches on the lenses, but a damaged headlight is a totally different matter from being not in excellent condition.
He said a refund is not possible, but he is willing to give me
