hands free illegal?

Default hands free illegal?

I was reading an article that said that using any type of mobile phone whilst driving was illegal in the UK - including the hands free type. Potentially the Police can check phone records to see if you phone was active at the time of an accident. If you were holding the phone it is dangerous driving and if you have a hands free it is driving without due care and attention.

I had always thought hands free was OK. So what's the point of all the hands free kits sold in the UK?,

From what I understand, hands free kits are not illegal but highly advised not to be used whilst driving

HI.

From what i understand.....and i could be wrong...

It isn't illegal to use a mobile phone, or hands free kit in the uk while driving.....It is however illegal to drive "without due care and attention" and this iswhat you'll be charged with....

If you have a hands free kit and are using the phone and you have an accident this could be taken in to consideration..

obviously if you dont have a handsfree kit and you have the phone squashed between your ear and shoulder then the case is a lot easier to prove!

Actually this is very open to interpretation and comes under 'Not Having Proper Control Of Vehicle'

This covers all eventualities, from driving with a black labrador on your lap, to getting a blow job whilst driving.

Hmm.... I suppose the courts will decide in their wisdom, but I can't really see how using a hands free is wildly different to holding a conversation with a passenger!

Thats a highly trained labrador you are talking about there!! But surely thats more of a case for calling the RSPCA than anything else!!!!

Interestingly I was reading in the paper this morning that the government have backed down from a plan to make driving and using a hands free illegal, they state that it would not be possible to police properly and waste too much of the courts time. An argument that has been publically attacked as some experts believe it is more danergous than drink driving, I find that hard to believe....

I honestly can't see the logic in having a go at 'hands' free users when people have been urged all along to use them. On the other hand I've scant sympathy for the one-handed drivers with neck problems who seem to be everywhere these days. I see a guy in a 5 series BMW most mornings and I can honestly say I've never seen him without his mobile clasped to his ear!
