One of our employees got caught by a speed camera on Nutull Rd, Notts,end Aug 03. We sent the first ticket back, saying that we did not know who was driving! Oh yes it was for doing 35mph, at 11pm on a dry dual carrageway, the speed limit is 30.
As I was saying, we sent the ticket back, but they sent another one back, with a 'full frontall' photo, but you still could not see who was driving, so we sent that back saying that we would help, but still did not know who was driving! - as I was running a vehicle transport company, at the time, delivering new and second hand cars employing 5 drivers. Aplogising that we did not have a record of the drivers on that day. We heard no more untill 2 weeks ago, when a court summons was the next thing to arrive, so as soon as the letter came through the door, we repled to Nottingham police ticket office, saying that we have tried a few times to find out who was driving the car but because no one would admit to driving, we couldn't help at this time, so would it be possible to overlook the matter? We heard nothing until last Friday's post when I received a

Hear what you saying, we've a dual carriageway here and it's got a 30 MPH on it, madness. They claim accident black spot, which is true but if they closed the right turns across the carriageway it would be a lot safer. Now all we have are 30 MPH smashes in the same places?

You could nab the driver and send his licence in claiming in a fit of remorse he came forward and volunteered himself up. You pay the fine? He gets the points?

what justice!!!! No such thing anymore!

I was stopped for speeding at 3.30am in the morning! Not a car on the road apart from a cop car hiding in a layby. Was told i was breaking the law no matter what the time of day and didn't matter if the roads were empty!

I'd say get on the phone first thing tomorrow to one of them legal types,

not a legal beagle but is the car registered in your name first off ??

the Hamiltons got away with a speeding fine not long ago by saying they could not remember who was driveing so if it worked for them it can work for you

Lloyd, don't get me wrong, I'm no apologist for the police and the current speeding system - but where's the injustice you complain of? Unless you're going to claim that you weren't actually speeding, you should just take your lumps and learn the lesson.

I agree, it might have been better for the copper to have had a quiet word, given the fact that it was so late and there was nothing else around, but that's a matter for his discretion - the fact of the matter is that it's a strict liability offence: if you're over the limit, that's all that counts. Anything else is just something for your plea in mitigation if a court appearance is required.

Burnie, I'm not sure what the position is. It's certainly true that the Hamiltons got away without being done a few months back because they claimed to be unable to tell who was driving at the time, but I'm not sure how that's reconciled with the law which requires the registered owner to identify who was driving or, if they don't, accept the penalty themselves. RTA work isn't what I do, but think in this case that there's sufficient uncertainty to maybe make it worthwhile having a quick chat with someone who does before you decide whether to challenge the ticket and expose yourself potentially to an even bigger fine and legal costs.
