cheers guys! i've just sent a letter to the garage i bought it from asking how it wasn't picked up on the full service or the checklist when i bought the car! i've only done 3.5K miles!! I'm going to try the warranty route, if not then i'll go down the small claims route!

What did you ask them to check before you purchased the car?
Similar experience here, my No 4 piston rings have failed and the Warranty Company has refused the claim saying it is fair wear and tear, and that the problem must have been there before I got the car and as such they're not liable
It is arguable that everything wrong with a six year old car would be fair wear and tear (that's the only exemption in the small print) so it appears that my Honda Used Car Warranty is a complete crock! Oh yeah, that'll be

Hmm. No expert on this at all, but even a used car must be of merchantable quality when it is sold.
I've no idea whether something like this does fit into the list of things that ought to be picked up before sale. Anyone know?

My car is a little over six years old and had 81600 on the clock when I bought it. I've owned it since July 31st this year, and have covered no more than 2.5K miles in that period. The fault was reported to the supplying dealer on the 16th October, and then taken to my local dealer on the same day.
Having read your extract I think I have reasonable cause to ask the supplying dealer to cough up, or repair the car themselves. It's got to be worth a try.
