Hi all

I purchased a TomTom Navigator 3 & ipaq bundle from www.globalpositioningsystems.com last Wednesday. On their website it indicated that orders placed after 31st March would be eligible for a free upgrade:

TomTom Navigator 3
UPGRADE TO NAVIGATOR 5

TomTom have announced that from 1st May 2005 ALL customers who have purchased Navigator 3 after 1st March 2005 will be entitled to a FREE upgrade (excluding postage and packaging) from www.tomtom.com. All customers who have purchased Navigator 3 before this date will have the option to upgrade for a small charge to be confirmed on www.tomtom.com
HOWEVER, I've just spoken to Tomtom and have been advised that NO SUCH OFFER EXISTS.

Moreso, this offer has mysteriously dissappeared from globalpositioningsystems website.

Tomtom verbally advised me that they have had a number of similar complaints.

I've written to Tomtom requesting written statement that the offer doesn't exist, and asking if either a) they intend to take action against this company or b) if they would support a complaint by myself (i.e. Trading Standards) by providing written evidence of similar complaints.

I'm currently waiting for their response and considering my next move. I have written to 'gps' yet, other than my initial query as to how to obtain the free upgrade (the response to which was to simply give me Tomtoms tech support no.).

Anyone any thoughts about how best to pursue this? Any lurking lawyers...?

And Tomtom are equally bloody useless, it seems.

My letter to them:

I have recently purchased a Navigator 3 + Ipaq bundle from www.globalpositioningsystems.com on 26/04/2005.

At the time of ordering, their website stated that I was eligible for a free upgrade to Navigator 5:

The above information has subsequently been removed from their website, however I have a copy of the web page at the time of the order clearly stating this.

I have contacted 'globalpositioningsystems' who have simply given me your tech support number by reply.

I've spoken (this morning) to your technical support and have been advised that no such offer exists and that you have had similar complaints.

1. Can you (Tomtom) please clarify (in writing) that you have no intention of honouring the offer as stated by www.globalpositioningsystems.com?

2. Can you (Tomtom) advise me as to whether you have any intention of taking action against www.globalpositioningsystems.com?

3. Can you (Tomtom) advise as to whether you would support a complaint (made by myself) against www.globalpositioningsystems.com by providing evidence of similar complaints from other customers regarding this company, should this be necessary?

Dear Mr Laughton,

Unfortunately we have little control over how our resellers market the TomTom product. We reccomend that if your reseller has misled you that you take it up with them and seek a refund or, alternatively, a reimbursment of the upgrade cost.

You may also contact the relevant distributor to lodge a complaint against the reseller. The list of UK Distributors is availible at http://www.tomtom.com/stores/type.php?ID=3&Country=222

And what use is the list of UK Distributors to me (i.e. Dixons, PC World etc)?? Are they saying that 'globalpositioningsystems' buy from one of these distributors?

Well....I wrote to 'gps' last Tuesday asking what they intended to do about this issue, pointing out that their website clearly stated that the offer included a FREE upgrade (which incidentally I found a copy of in the Google cache, despite it being taken off the 'gps' website!).

I wasn't expecting a reply tbh, so this was a most pleasent surprise in my Inbox this morning:

I did say Garmin was the GPS solution for men.

Tomtom is a childrens toy.

I have stats to back up this bold claim.

Had a Garmin Street Pilot 3

Got rid of it & got TomTom/PDA instead. Much happier now.

How old is a streetpilot III? Its about 7 years old.

The toytoy3 is a baby.

I had lots of problems with globalpositioningsystems with my 1st Ipaq and TomTom. Sent it back to them in disgust.
