Default DUI question in Michigan

this is what happened to a friend of mine.
My friend was drunk driving, spun out, and hit a center divider. He was taken to a nearby hospital. He doesnt remember if cops were there or not. (he was very drunk and im sure he hit the center divider pretty hard since the car is totalled) All he remembers is he was getting checked out at the emergency room, they took his blood out, MRI check up, and then he was out in the morning. They gave him billing info and number to the tow trunk company.

my question:
is he going to be charged as DUI?

i would appreciate it if some of you can provide an answer or two
thank you

most probably YES.

just because he didn't kill someone, doesn't mean he isn't going to be charged.

I'm not 1000% positive... but I have to say NO.

If the cops were going to do any charging, a cop would have waited until he was conscious (assuming he lost consciousness) and given him multiple tickets. If this did not happen, then he got out extremely lucky.

Vassil,

They took his blood out for tests. They may be able to use this when issuing the tickets and deciding on charging him with a DUI. Sorry to sound negative, and maybe he may get lucky. Take a look at Cook County Court system, it's slow as hell. Doesn't mean they aren't going to catch up.
IF there wasn't any police reports made he has an awesome chance, but in most cases the reports state possible cause of incidence.

Actually, they would have arrested him as soon as he was released. Regardless, sounds like he may get lucky on this. Hope he learned a lesson though.
