I've ran a test pipe without spacer on my 04 and did get a CEL. The spacer doesn't cost much though.

My Invidia came with the spacer...guess I assumed Nik had the spacer and it was part of the sale on the TP. To correct myself, I have an '04 with 70mm TP and the Invidia spacer and no cel.
