You won't pass with an AEM EMS.
In order to pass with an EMS you will need to go back to stock injectors, stock map sensor, and swap the stock ECU back in. If you removed the air pump will have issues with a check engine light.
There isn't a way to keep the wastegate "open", but it shouldnt' be a problem as long as you drive it lightly and never cross 0 vacuum. You only need to pass a stationary code scan, so the car will never see the rollers.
I passed with a kpro without any issues. The kpro install is a bit more involved than an AEM install though.

or just pop off a coupler...
Kpro is the route I would like to take to make things easier or at least in the long run just the price is a bit up there and trying to weigh out if the option is more worth it to switch back to oem parts with aem ems for emissions or to just get the kpro.
Thanks to everyone
The air pump on a stock ECU will generate a check engine light if removed. I think there are a couple jumper harnesses available online that may eliminate the check engine light on a stock ECU though, which may save you when passing emissions when swapping to a stock ECU from an AEM.
The RSX doesn't utilize an air pump, so the entire air pump circuit won't throw a code when using a kpro. I have had mine removed for about a year, and have had not problems in November when I did the emissions test.

KPRO will save you a lot of hassles come emission time, although it's now only every 2 years in Tucson for OBDII cars. There is no way to eliminate the CEL with the air pump removed on a stock ECU. So if you have AEM it will be much more involved to go back to stock and pass emissions, entire air pump assembly will have to be re-installed. That said, I have an air pump CEL and have gone through 3 times just by clearing the codes, driving around for 10 minutes, and then going through emissions. It sets enough readiness monitors to pass emissions but the CEL hasn't triggered yet.
I would not have a turbo S2000 for my only transportation. Pick up a beater Civic or something just in case.
