state ref. might not let you pass the test, for instance you go the smog places and if you dont pass u might try if couple more times, its a place that will allow you go 1 or 2 times more if they think that you havent put it back to stock or carb legal.

State ref can't give you a ticket. They only have jurisdiction to check what you have been cited for. Ref can say something but can't give you a violation ticket.

Best to avoid situations like that. Strange he made you pop the hood when the only illegal thing was the intake..... makes me think about my gross pollluter and ALL the times i've been on the side of the road
