if you fight a speeding tix with a written declaration, do they take away your right to go to traffic school?

It's up to the judge.. But you can do Trial de Novo, and when you go in, ask for Traffic School.

In most cases the court will grant you traffic school. Just know that the judge HAS the power to take it away. Be respectful to the judge, otherwise things can go sour.

Three things to put in the letter:

1. i'm not guilty and here's why. Doesn't matter what you write here as long as it's something the cop has to respond to. If you really aren't guilty you need to go to court in person and plead your case in my opinion. The other thing you can do is say is for instance: 45 in the 35 zone was safe.

2. please give me traffic school if you find against me. Although the pros say you should never ask for traffic school on a 1-point infraction. You ask for traffic school on two point infractions, which only the judge can grant. This decision will come down to how crazy you drive and if you need this leeway.

3. given a, b, c, etc. please reduce my fine if you find me guilty.

I just got a ticket two weeks ago going 60 in a 40..

Two years ago I was clocked from the helicopter cop going 98 on the toll road, and I had to appear in court for that one. Two CHP cars had to pull me over for that one after the helicopter had called him. I asked for traffic school, and the judge said NO way lol But he reduced my fine if I pleaded guilty which I did.

So I am bitter about getting caught for a 60 in a 40. But its been two years since my last ticket, so I should be offered traffic school for this ticket.

Just like the members say, its up to the judge of traffic school!

Goodluck!

That's a one point violation I believe so you can get traffic school.
