Steven2k, I work at a law firm. Unffrotinatly, none of the attorneys here handle these type of cases. I do believe though that most of these cases end in a Settlement and not a Judgment. It all depends on the Plaintiff. If you think the lady is nice, hispanic or not, she might not even sue. So, I agree with all the others that say seek you gf now and let the insurance take care of things.

they were stopping. they didn't come to a complete stop. also remember that I didn't say the pedestrian was being reckless, that was the witness's statement.

The situation sucks, but put it in perspective:
The pedestrians weren't killed or maimed! This is obviously good for them, and good for your girlfreind because she doesn't have such horrors on her conscience; the rest is just money. Yes the money part can suck, but when it does, just remember it could have easily been much much worse.

Get a good lawyer ASAP. I have a good one to recommend, if you're interested. He's helping me out with my S when it got rear-ended twice in one month. Granted, being rear-ended is different, a lawyer would still be able to know what to do and not to do and help you with the case instead of having the insurance company (wether it's yours or the other party's) try to screw you (which is their primary job, screwing people).

Getting your own lawyer would not be smart in this case. Here is why: You pay for insurance and in the contract is the insurance companys duty to defend you if you are sued. In other words they have the obligation to provide a lawyer to defend you which your insurance will pay for. If you go out and get your own lawyer, you will have to pay 100% of that.
Like I have been telling you all along now, cooperate with your insurance company and let them handle this. They hire professionals who handle this type of stuff all day every day.
