got in an accident today.
well on my way home i was goin about 20-15 mph while approaching a stop lite and as i was braking the girl in front braked significantly harder so i braked hard too but i guess i was too close even those i was around 10-15 feet away and i hit her and she rammed into a camry. im only on my temp licesnse btw. so the cop came and said it was my fault for both cars. it was like a lil fender bender. but heres my question, why is it my fault for both cars? if she was following the 3 second or a car and half rule then she shouldnt have hit the car in front of her. anyway i talked to the guy at my insurance and i had to tell him bout my friend in the car. and he needs to talk to her. what do u think hes gonna ask her cuz shes not allowed to get rides and if her parents find out they're gonna kill me and her. so hopefully she doesnt need to go to court. but anyway any feed back is nice. and yea im ok
Yep, all rear ends are pretty much considered the fault of the driver in the rear. You are responsible for both cars because you caused the 2nd driver to ram into the 1st driver. If you did not hit her she would not have collided with the 1st car. Sucks for you though, but you will lose if you try to take this to court. The insurance company is trying to cover their butts, so they will definately talk to her to get a different perspective/story. No way around it. They will probably ask her to give her story. Unless somebody claims injury, probably 90% of the time the insurance company will just settle. Good Luck.

are you sure......what if someone rams you while stopped and you hit the car in front. I don't think you have any liability then.

Since my best friends mom runs an insurance agency, and my mom works in the industry (but shes on the home insurance side of things, still knows autos)... yes I'm sure.
Now of course it could be different for your area but I'm just going by what it is here.
I also know from my own experience because I was the front car in a 3 car collision. The driver in the middle was 50% responsible for my damages. (The light went green but I stayed still as an ambulence was driving across the intersection at a fast speed with their lights ON)... truck hit the car behind me at a very fast speed, and the lady behind me only hit me because she didn't have her brake on (manual tranny).
