Considering that his name is Nissan and he incorporated his company while the car company was still called Datsun, Nissan Motors can FOAD for all I care - he is in the right, they are just trying to intimidate him.

I'm not sure if Nissan has a case. Yeah, they have the name, but can Intel sue anyone who uses the word Intel in their name? They're trying, but losing.....

What about www.pioneer.com I'll bet thats not the company you would think of, so should they sue each other?

Where does it end? What if a company patents the letter I or P, can they sue anyone that uses those letters? Intel tried a few years ago, and Paris Hilton is trying for P right now so she can open her own brand.

I think if this small company was making cars or car parts thats one thing, but last time I checked those two didn't compete much. Nissan just can't stand not having that domain name.

Maybe I should start up www.nissan.org and see what happens

Also a 3,000 year old Hebrew word, but for the purposes of trademark dilution, it's a bullshit idea to say that anything this guy has done (compared to what Nissan Motors themselves have done with their litigious badgering) has significantly tarnished the brand name...

The 9th Circuit Court disagrees that the dilution claim is bullshit:

The court determined that Nissan Motor’s dilution suit was not barred by laches, that Nissan Computer’s first commercial use of “nissan” was in 1994 when it registered the website “nissan.com” because that was the only use identical to the NISSAN mark, that by then Nissan Motor’s NISSAN mark had become famous, and that Nissan Computer’s use of “nissan.com” dilutes the quality of Nissan Motor’s mark. Accordingly, the court enjoined Nissan Computer (and its alter ego, The Internet Center Inc.) from posting any commercial content at nissan.com and from placing links to other websites that contain disparaging remarks or negative commentary about Nissan Motor.

This court battle has been going on for a LONG time. I remember typing in "nissan.com" years ago and getting a page with a similar message on it.

Apparently this is one lawsuit that will never end.

He should turn it into a free porn site with nekked women screeming how great Nissan cars are when they climax.

This whole case is retarded. Nissan is upset because this guy beat them to the internet. The 9th circiut court is retarded as well for wasting their time on it. The only thing diluting the quality of Nissan Motors' mark is Nissan Motor whinning about it.

You can chalk this one up there with the fat kid sueing McDonalds...

I agree with Dispader...... Just cause Nissan was slow to figure out that thingy called the internet doesn't mean they can throw their weight around.

And the 9th Circuit court is the most overturned court in the country, so no worries there.
