Default Tree falls oncar, Need Advice
















This happened this morning while I was at work , my wife called me and this is what she saw. I rent the house right now.

My question is who do I file an Insurance claim agains , my car insurance or the landlord's insurance.

Your landlord's insurance won't cover your property's damage. I know this because I'm a landlord and I tell my tenants to buy renters insurance. So you'll need to file a claim with your car insurance company.

It's his tree that was obviously rotten and was brought to his attention. and he did do nothing about it

I'm not a landlord, but typically a landlord is not responsible , insurance-wise, for damage to your personal property. You'll need to go through your car policy and hope your deductible isn't astronomical As for another writer's statement about the landlord having knowledge of the rotten tree. Well, you may have a cause of action in negligence which could possibly help you recover some damages, but you would probably need to pay an attorney to file a claim since the damage amount is to low to represent you on a contingency basis. Maybe your insurance carrier will sue the landlord

I talked to the landlord about this, he was willing to pay for tree removal and my deductible. he was blaming me at first for not parking the car in the garage.

Im glad my insurance had $100 deductible, thank GOD. Will my insurance rates go up?
