Anyone know about traffic law and the highway code?

Default Anyone know about traffic law and the highway code?

There is a construction site just round the corner from us. The stretch of road either side is marked as a "no stopping" zone for a total of about 500 yards - but the contractors vehicles park there all day from c07:30 to c16:30, causing an obstruction.

About a month ago, I contacted the local council who told me it was a police matter so I reported it, twice, to Thames VAlley Police (TVP) who said they'd investigate. TVP left a message to say they'd spoken to the site manager about the mud of the road - but no mention of the obstruction issue. I then esclated to the local Parish Council who asked the village PSCO to investigate. After chasing her, she informed me the police are not responsible for enforcing parking regs (despite me saying it wasn't a parking violation (as there aren't any yellow lines) but a obstruction on the highway - instead she referred me back the council (who actually outsource parking enforcment to an outfit called NSL). Her sargent then took umbrage when I said that as the police seemed either unwilling or unable to enforce traffic law, I wanted to raise a formal complaint with the Chief Constable.

He again told me to talk to the council, which i did. Not surprisingly, both the council and NSL tell me there is nothing they can do as the traffic regulations they are responsible for only apply to parking - as there are no yellow lines, there are no parking restrictions It seems the "no stopping" restriction doesnt actually mean no parking

They have told me it is a matter for the local police...

So the saga continues...

Write to the police saying basically what you have said here ... do not rely on a local Sergeant and certainly not a PCSO. Obstruction is down to the police but more than just parking is often now down to the council. I am taking it that the road in question is a public road ? Do not be concerned the Sergeant seemed to have the hump ... you can complain if you want ... so do

Can you not buy some yellow paint. Road should be quiet next weekend.

Contact your local planning office to see if the no stopping zones have been suspended, and explain the situation to them, then the highways dept for clarity on what a no stopping zone actually is. Sounds like the ccouncil found a spare sign in a cupboard and had to put it somewhere.

Have they any signs up which say they are in the considerate contractors scheme. If so complain to them too.

Lot of ballache for you though. How much longer are they going to be there for.

Might be worth checking whether there were any parking conditions in the planning consent. There often are.

May be they cannot park on-site ATM, since everywhere is like La Somme.

TBH - that's their problem not mine! They've already told the local PSCO that they have arranged use of a neighbouring field for off site parking.

Would the parked cars obstruct emergency vehicles? often the Fire service like to see these problems cleared up or so I'm told.

Success - an apology from the local police sargent!

I owe you an apology, having now visited the area in have seen that this is in fact a clearway and that is enforceable by the police as opposed to merely a parking issue which is not. I have referred this matter to PC xxxx to liaise with you and see if we can resolve the matter. My understanding is that there should have been land set aside for these vehicles to park but due to a legal complication, I am not sure what, this is not at present the case. The builders will have to stop work if they can’t get deliveries to the site
