Default Had a bump

I've just had a bump in the Laguna

The car in front was pelted with snowballs by some little chav b******ds and stopped in the middle of the road (no brake lights came on) leaving me nowhere to go. except into him at the princely speed of about 6-8 mph.

The road is completely untreated and I've been informed that the council have ran out of grit!

The person in the other car didn't know his reg number and there seemed to be a rabbit off as there were no brake lights. I phoned the police and they said just swap details and thats it. even though the kids came back and continued pelting the passing cars. I could even see the houses where they were coming and going.

so no brake lights - police not interested
kids causing accidents - police not interested

The council have made no attempt to maintain the highway which is a main road.

What obligation does the council have to maintain the road?

I am seriously P****D OFF!!!!!!

Annoying.

Your insurance co. might be interested in his vehicle being unroadworthy. I'm sure it causes more accidents than drink/drive/speeding/add any other whipping horse.

What obligation does the council have? Like, "we've had your tax money, now F UCK OFF!" They'll blame Highways Agency & they'll blame the council..

I've been doing a search and have found this extract in the Highways Act 1980:

sec 41.
Duty to maintain highways maintainable at public expense.—

(1) The authority who are for the time being the highway authority for a highway maintainable at the public expense are under a duty, subject to subsections (2) and (4) below, to maintain the highway.

[F100 (1A) In particular, a highway authority are under a duty to ensure, so far as is reasonably practicable, that safe passage along a highway is not endangered by snow or ice.]

I remember drivin along a road in NZ in the middle of the summer when a ball of snow/ice thudded onto the windscreen pretty hard. I've never been so surprised!!

Turnss out dad was defrosting the fridge/freezer and they thought it would be funny!

Not really.... They weren't responsible for the accident

Will be interesting to see what the councils will do with all of the car size pot holes being generated by the ice and snow. Seen a few that an S would fit in nicely, a few indeed on Sunday during the Herts meet drive.
