Default Just got a NIP for the beater

A Notice of Intended Prosecution arrived this morning for 51 in a 40 on the 14th at 07:20 in Tower Hamlets. I live in Surrey and the car was on my drive. To me it's obvious that someone is using my plate but how do you prove this.

I've phoned the Met and they have asked me to return the NIP with a covering letter.

Have any of you had this happen to you and is there anything I should be aware of.

Will be interesting to see if the cloned plate is on a car which is the same model, colour etc. I should think as it is a beater it won't be and therefore will be a easy thing to disprove.

Don't fill in the NIP but put all the info in the covering letter.

The NIP is admissible as evidence as identifying the driver at the time of the alleged offence.

Methods of trying to "get out of" valid charges aside, because it's definitely not you or your car in this case I wouldn't touch that form with a bargepole - the relatively automatic process of dealing with them could well mean your argument that it's not your car gets overlooked/ignored in favour of the fact that they have a filled in NIP.

Despite the strongarm tactics used in prosecuting speeding fines, genuine cases like yours are usually dealt with sympathetically - just follow the advice from the Met and you should be fine.

This really shook me because I'm fairly careful about not speeding and it took me a while to see the date and place of offence.

One of the guys on PH had a similar problem recently. He got a fine for stopping in a hatched area. The fine letter had a picture of his vehicle a moped with the correct reg number. Only thing is he drives a Porsche Cayman.........

They had a process for dealing with it online so it's obviously a regular occurence.

I like that.

I just hope mine is as cut and dried.

It took a few calls around various police switchboards just to find someone who could say "send it back". No mention of a web site but when it comes to scameras they don't want to be too helpful.
