That fits with things posted on a similar thread about this story on PistonHeads - by reputation, Richard Lukins, the owner of the bodyshop where it happened and presumably the owner of the car that the guy thought he was trashing, is seemingly an unsavoury character of rather dubious business ethics.

the criminal fine is going to the crown, not to the poor sod who owned the Ferrari. Hence the civil courts are required 
Quite why the trial judge didn't do so here, I have no idea. Perhaps there are limitations on the circumstances in which it can be imposed - I don't know.
