So Im getting married, and I want to buy my fiance's car from her mother (jane doe) (she secured the loan due to divorce issues) the loan is through loan company A in the name of jane doe. i am getting a payoff from loan company B in my name. LC B will payoff directly LC A. the title would then be sent to Jane Doe, correct? the Jane would need to send the title to? LC B, or me to give to LC B? I also need a few forms (per the DMV: MVR-1, and MVR-181). If Jane is "giving" me the car do i need to buy it for $1? will sales tax be applied in FL and NC?

any help would be appreciated as this will be happening this week.

If you buy the car after you get married, you do not have to pay sales tax as in NC if you sell the car to a family member it is not taxed (for what resaon I don't know). If loan company B is paying off directly, then loan company A will send the title to loan company B directly, usually takes a minimun of 10 business days. I'm not sure of every form you will need but you will need a damage disclosure form, an odometer disclosure form, bill of sale (to act as a receipt), proof of insurance, application for a title, and an application for tag. if your future in-law trusts you, I suggest getting a power of attorney form made out so when you go to transfer everything, you will not need to go back and forth from her to you and the DMV.

 

thanks for the info. believe it or not, i called the DMV and actually got a response similar to that, though I had to continually ask questions.

on a sad note, my honda is outnumbered by the general 2-1, but she still gets a garage spot.
