I'm asking for a brief synopsis on what you are suing your landlord for?
Lease clauses affecting said issues;
Tenant is responsible for INSIDE repairs
Landlord is responsible for OUTSIDE repairs
Tenant is required to have a heating maintenance agreement (which we do) and is responsible for heating/ A/C repairs. (no mention of long term replacement)
Once it became apparent a repair made no sense we tried in good faith to negotiate with them. We offered to split the costs of a new heater (our figuring is we NEED to be here and have been a long term good tenant with a long term lease). They (The landlord is a they, and old tightwad slumlord and his bitch old wife) were defiant in there belief that it could be repaired and that would be our responsibility.
Time was of the essence since it was now COLD in our showroom and customers were complaining... complaining cold customers dont stay long enough to browse/shop.
We went ahead and replaced the heater and paid the vendor in full.
We are suing our landlord to recoup ALL COSTS, over $8000.00
Court date has been set for mid-July (after a venue change by the judge
) The local magistrate/judge removed himself from the case because he represents our neighbor tenant (Pizza joint) who is ALSO suing the slumlord over a no heat issue
