Whoa whoa whoa.. Thats bullshit. So he buys the truck legit from a car dealer then the cops come 9 months later and tow it away - and he still has to repay the bank?

Poor guy. $500+/month on something he doesn't even own.

But, he can sue the car dealer. That is the benefit of dealing with a commercial entity, their burden of due diligence is SOOO much higher than if he were to purchase from a private party... Chances are the dealer got it at auction, from a private party / another dealer. The dealer was responsible to verify the goods before they were purchased, much more so than the individual who bought it from the dealer.

Uniform Commercial Code is going to screw the dealer. If the dealer does not have cash, there is still the judgement against them. The guy just has to sign his rights to collection of the judgement over to the bank, and it should go away.

Huge pain in the arse, though!

Yeah
He will have to go after the dealer. They have to be bonded so if they dont pay the bond company will. It still sucks balls.
Then the dealer will have to go after the auction that they bought the truck at. Then the auction will have to sue the dealer that sold the truck at the auction. And if they dont pay for it then the bond company will.

ALL IN ALL the only winners will be the Lawyers.

yea. If you buy a stolen car, they will take it and your left with nothing but what was said above. I heard some stories. sigh.
