If you must fight it, go back to the spot and measure the distance from the light to where he would have targeted you... the distance shoudl show that there was no way you could hit 91 in such a short length of road. It's still not definitive proof since you may not have been stopped at the light but rather already in motion, but it's yet another piece of "evidence" to help strengthen your case.
The more research the better; judges love it when you come prepared. If you just show up and say you didn't do it, you may as well pay now. Research the radar guns, inconsistancies, get a book or two on fighting tickets, measure and take lots of photos of the site. You may not need all of it, but the judge will be impressed that you are making a case for yourself. I had a judge throw out a case, even though all the evidence was stacked against me simplly because of my research and questioning.
Wow I think the last two posts here from McGyver and Willie Gee, along with the video that Primogen linked, are the most important here.
Being prepared when being pulled over and then being prepared again when going to court can save a lot of headache. There's so much information on the subject you could write a book...oh wait they have, so go get a couple
i would suggest the no contest plea.....if you go for innocence you have to really prove your case.....unless the cop doesnt show. then your off scott free....but its a crap shoot.
That sucks. U know the cop when after u because if he would have gone after the bike, the bike would have probebly ran. I heard Cape Coral cops cant go over 80-90mph thats why bikes run all the time. I say fight it. Good luck.
I have never personally gone to court - but I have yet to actually pay a citation or take the points. In thee past I have used a local "ticket clinic" instead. You basically pay them to take care of thee situation for you. It is usually about 80-90 bucks - you explain thee situation - then wait to hear back from them after thee courtdate. ONE time I had to pay about $140 in court fees on top of their fee, but like I said before, it has always been a success = no ticket fine/no points. Just an idea if you find yourself nervous or short on time. I am pretty sure, however, that only larger cities are able/willing to provide such services, so check out your area.
Good luck!
You would file this with the Clerk of courts IN THE AREA YOU GOT THE TICKET (traffic court were you pay the fine at) You want the judge to WITHHOLD ADJUDICATION!!!!!! This is very important!!!!!!!
Attach a letter of statement of what transpired before and during the situation including weather conditions road conditions, traffic and alike. DO NOT ADMIT GUILT!!!!!
Next were it says circle one 1,2,3,4.
