I have never seen a non-compete hold up. If they were to take you to court, they have to demonstrate that your leaving the company has harmed them in a significant and financial way.

You only need to state that sales is your chosen profession and that they have harmed you by downsizing. Of course you would have to adhere to the confidentiality clause.

My previous employer had us sign one and when I left he was so pissed that was going to "take me to court" I said, great ask Gary (our lawyer) how much weight it actually had being that I was in this business before I started here and this was my chosen profession. It was dropped pretty quick.

The way we enforced our no compete clauses was to contact the new employer and threaten them. We are in a rather small niche so we usually knew if someone stayed in the biz.

Morning all this merger shit sucks. It's been funny telling these guys how a low budget operation runs and watching their heads explode but I have so much work to do for these guys it's insane.
