Dude you stated that they were bald I'm going to assume that they are down past the wear bars thus making them not road worthy.

So if you say that they are road worthy how did you crash doing only 40 mph and from the pictures hardly any rain? I see a spotty bit of rain on the soft top and a slightly damp road where there is no tree cover. That leads me to believe that when the pictures were taken (I see EMT,Fire and Police) and if you had to have stitches and cleared by EMT the pictures must have been taken long after that. I'm going to assume that when the crash occurred there was no rain present you either suck at driving or were driving like an asshat.
I've got to agree with Nick here. Too often I see someone wreck and use the same responses as the OP. Meanwhile they've got an aftermarket parts all over the car. Maintenance comes first, then toys.

Consider this a lesson learned for the future.

It was raining when it happened it took a while for the authorities to arrive, and the roads are worst when it first begins to rain

Jeez! Can you explain your windshield (or did I miss that?). Airbags deployed obviously...but did your head/face hit the windshield as well? It *looks* like the impact was from the outside pushing inward?

Glad you are okay. Obviously it could have been much worse. Get better soon.

Might be interested in the entire long block/transmission. See what the insurance company would want to buy it back.

Vulture? Maybe.
