Your lawyer will be able to tell you better than anyone else.

Good luck, man... Keep the tire squealing to the track, or get a low horsepower car like I have

Yeah...umm...what you did was knuckle-headed...

6 loud-ass cars, screeching tires, and a garage at 11 at night, isn't the best move. Good luck.

My first question is whether or not the police can ticket you for behavior on private property - i.e. not a public road... Wouldn't autox's at FedEx and other commuter parking lots be illegal, technically? Wouldn't the garage have to be private property for a trespassing charge to be valid?

The way I see it, either the trespassing charge is invalid or the reckless (not wreckless - tho it's good you were wreck-less ) charges are invalid. Trespassing may be invalid if it were public property, reckless may be invalid if it's private property...

Not trying to be a jerk, it's an honest question. For example - can they give you a seatbelt ticket for not wearing your seatbelt on your own private driveway?
Traffic violations in Va cannot be ticketed on private property. However, Reckless Driving tickets can be. Why? Because it's a Class 1 Misdemeanor and involving possible death due to his/her actions. So no, you're incorrect and yes, this charge is valid.

Trespassing charge can be issued on private property if the management company for the garage has given Fairfax Police the authority to patrol during off hours, which is usually the case in all the garages and shopping centers in this area. Trespassing can also be issued if it's public property as long as the police can prove there was no need for that person to be there at that time, since no business' were open and that person was up to no good.

Not to be a butt head, but fresh2k choose what people say on the internet wisely. On the internet you have a lot of keyboard attorney's. Do your research if need be. You'll need an attorney for the reckless driving ticket, but don't go in thinking that the advice you got on the internet is the word of god and that it's going to be helpful to you. Some are, some aren't.

i agree with Peter. Reckless is jailable offense. If you go to court without an attorney, before you plea, the judge will strongly recommend you to talk to a lawyer anyway.

I would heed those words - I had a reckless recently and in the end, it's what your lawyer says (and consequently, the judge) that matters.
