bye bye s2000!
Glenn:
I think Bass and I might just need a mediator because I don't think either of us is going to be giving in any time soon. No matter what ONE of us is not going to be very happy that is for sure!!!
That or we have to just pick a number/flip a coin etc.
I see Steve's point of doing some work to do research into this though to the same degree it was my idea to begin with. If not for my idea Steve(or anybody else) wouldn't even have a [edit]leg to stand on[/edit] in with this situation.
Simple statement............if I knew that the trade in wasn't going to happen till Monday there is no way I would have let this get by me. I only did because the trade in was supposed to happen by Thursday. This has now majorly changed!!! I don't believe that 2 days of PM's and a trip to the hardware store gives sole rights to this.(end statement)
Steve............will you agree to a mediator? Or to something fair?

Fine maybe someone should volunteer to pay for it? I do know that I have nothing to gain from this but I also know that I did spend about 5 hours talking with Glenn and Steve and many shops and trying to figure out how to get this done tonight or tomorrow morning.
But whatever....
But whatever....
First dibs or not, Jim, you DID choose to give it up. In fact, you weren't even interested in the 4.77 gear, only SLIGHTLY interested in the 4.44 gears. To quote you, "If it was a 4.44 I MIGHT do it. Though [the 4.77] is a bit to high for me...", so why all the fuss about something you didn't even want? Steve has gone to a lot of trouble to make this happen, including research, a lot of calls, buying tools and fluids, etc.
It's not my call, of course, but you seem to be getting your back up pretty high for something that's free. It's not like this is a $20 pair of pink fuzzy dice

Sorry, Pinky...I have to side with Bass on this one by a narrow margin.
Even though you came up with the idea, you have publicly given up your right to it. Yes, unforeseen event took place and made you change your mind, but by then Bass has already claimed the item you waived.
Allow me to try this analogy: You pull into a parking spot on a crowded street. But then you found out that you don't really have change to pay the meter so you proceeded to vacate the spot. Bass noticed the spot that he would not have otherwise noticed if he didn't see you pulling out of it. Bass by now have occupied the paring spot. Only then did you somehow found out the meter is broken and you could've parked there afterall. Now, do you think that Bass should give up the parking spot to you? In biz law, I think Bass owes you.
With that said, you did bring up the idea first in which Bass benefits from. I think to resolve this fairly, amiably, and maintain friendship, the gear taker should compensate the other party. How about a bidding war? Whoever willing to compensate the other the most, takes the gear. That way, both parties can benefit from this fortunate find. Start the bid at $100?
